Equitable Servitudes
An equitable servitude is a covenant enforceable in equity against subsequent landowners who take with notice. Requirements: (1) writing (or implied from a common scheme); (2) intent to bind successors; (3) the covenant touches and concerns the land; and (4) notice. Privity is not required.
