Due-on-Sale Clauses
A due-on-sale clause accelerates the mortgage debt when the property is sold without lender consent. Federal law (the Garn-St. Germain Act) preempts state anti-enforcement rules and makes due-on-sale clauses enforceable in most residential mortgages.
