Recording Acts — Purpose and Types

Recording acts protect subsequent purchasers for value against prior unrecorded interests. The three types are: (1) race — first to record wins regardless of notice; (2) notice — subsequent BFP wins even if they do not record; and (3) race-notice — subsequent BFP wins only if they record first and lack notice.
